01Who we are and what these terms cover

Fluid Arena is operated by FluidSports Management ("FluidSports", "we", "us"). Fluid Arena is a brand of FluidSports Management, GSTIN 27AALFF0972H1Z9, at Before Godrej Building, Plot No 7, S No 81, Lane O, N Main Rd, Koregaon Park Annexe, Pune, Maharashtra 411036.

These Terms of Use apply to the website at fluidarena.com and to your use of the Fluid Arena premises and services, including court bookings, open play, coaching, memberships, corporate plans, run clubs, social nights, tournaments and other events, the café and the pro shop. By using the website, making a booking, buying a membership or plan, or entering the arena, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the website or the arena.

Specific events, memberships and corporate plans may have additional terms. Where they conflict with these terms, the specific terms apply to that event or plan.

02Entry and right of admission

Entry to the arena is subject to a valid booking, membership, plan or event registration, and to these terms and our court rules. Right of admission is reserved. We may refuse entry to, or ask anyone to leave, the premises for conduct that is unsafe, abusive, disruptive or unlawful, for being under the influence of alcohol or drugs, or for breaching these terms or the court rules. No refund is due in those circumstances.

You may be asked to show identification, a booking confirmation or a membership card at reception. Opening hours, court availability and the facilities on offer may change without notice.

03Bookings and payment

Courts, sessions and events can be booked through the channels we make available from time to time, such as our booking platform, WhatsApp or the front desk. A booking is confirmed only when you receive a confirmation from us, and in the case of paid bookings, once payment has been received.

Prices are shown in Indian Rupees and include GST unless stated otherwise. Payments are processed by third-party payment providers under their own terms. We may change our prices at any time, but a change will not affect a booking that has already been confirmed and paid for.

Please arrive in time for your slot. Court time is fixed and will not be extended for late arrival. If you have not arrived within 15 minutes of the start of your slot, we may treat the booking as a no-show and release the court.

Bookings are personal to you and may not be resold or transferred for profit. Bookings for groups, tournaments and private events may need a deposit and may carry additional terms, which we will share with you before you confirm.

04Cancellations, rescheduling and refunds

Cancellation, rescheduling and refund terms are as per the membership or corporate plan subscribed to. Please refer to your plan documents or ask our team for the terms that apply to you.

For ad-hoc bookings that are not covered by a membership or corporate plan, the cancellation and refund terms are shown to you at the time of booking, before any payment is made. By completing the booking you accept those terms.

If we have to cancel a booking, session or event for reasons within our control, such as a court being unavailable, we will offer you a rebooking or a refund of the amount paid for that booking. If we have to cancel or stop play because of weather, a power failure, a safety concern, a government order or another event outside our reasonable control, we will offer a rebooking or credit where we reasonably can, but we are not otherwise liable for the cancellation.

Refunds, where due, are made to the original payment method and may take 7 to 10 working days to appear, depending on your bank or payment provider.

05Memberships and corporate plans

Memberships and corporate plans are offered on the terms set out in the plan documents you receive when you sign up, including the duration, the benefits included, the number of users, booking windows, fair-use limits, and the rules for renewal, freezing, cancellation and refunds. Those terms form part of your agreement with us.

Memberships are personal and may not be shared or transferred unless your plan says otherwise. Corporate plans are for the employees or members named by the sponsoring organisation, and the organisation is responsible for telling us when a user should be added or removed. We may suspend or end a membership or plan without refund if these terms or the court rules are seriously or repeatedly breached.

06Court rules and conduct

Everyone at the arena must follow the court rules displayed on the premises and any reasonable instruction from our staff. In particular, you agree to:

• wear non-marking court shoes and appropriate sportswear on the courts;
• respect other players, staff and visitors, and keep language and behaviour courteous;
• keep to your booked court and time, and leave the court promptly when your slot ends;
• follow open-play rotation and queueing rules;
• keep food and drink, other than water, off the courts;
• take care of the courts, nets, equipment and facilities, and report any damage or hazard to staff;
• not smoke or vape anywhere on the premises, and not bring or consume alcohol or illegal substances.

You are responsible for any damage you cause to the premises or equipment through negligence or misuse, and we may charge you the reasonable cost of repair or replacement.

07Health, fitness and assumption of risk

Pickleball, yoga, running and other physical activities carry a risk of injury. By taking part you confirm that you are in good health and physically able to take part, that you have consulted a doctor if you have any condition that could be affected by exercise, and that you will stop and tell our staff if you feel unwell or are injured.

You take part in all activities at the arena at your own risk and you accept responsibility for your own safety and for any injury or loss that results from your own actions, your physical condition, or the ordinary risks of the sport or activity. Please warm up properly, use suitable equipment and play within your ability.

Our staff are not medical professionals. We will call emergency services if needed, and you agree that the cost of any medical treatment is your responsibility.

08Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited under Indian law.

Subject to that, we are not liable for any loss or damage that was not caused by our breach of these terms or our negligence; for any indirect or consequential loss, including loss of income or enjoyment; for injury or loss caused by other players or visitors; for the acts of third-party providers such as payment gateways, booking platforms or social media platforms; or for loss or damage to vehicles or personal belongings, as set out in section 09. Where we are liable to you in connection with a booking, membership or plan, our total liability is limited to the amount you paid us for that booking, membership or plan in the 12 months before the event giving rise to the claim.

09Personal belongings and vehicles

Please keep your belongings with you or use any lockers we provide. We are not responsible for the loss, theft or damage of personal belongings, equipment or vehicles brought onto or parked at or near the premises, except where caused by our negligence. Items left behind are kept for 14 days and may then be donated or disposed of.

10CCTV, live streaming, photography and recordings

The arena is monitored by CCTV for the safety of players, visitors and staff and for the protection of property. CCTV does not cover changing rooms or washrooms.

Live streaming and publication. Our CCTV and court cameras have live-streaming capability. Matches, open play, coaching sessions, tournaments, social nights and other events at the arena may be streamed live, or recorded and published later, on Fluid Arena's own channels and on social media and video platforms such as Instagram, Facebook, YouTube and X, and on screens inside the arena. We may also take photographs and video at the arena for the same purposes.

Your consent. By entering the courts and play areas you consent to being filmed, photographed, streamed and recorded, and to Fluid Arena and FluidSports Management using, editing, publishing and distributing that content, including your image, likeness, voice, name and team name where announced, for the operation, promotion and marketing of Fluid Arena, in any media, worldwide, without payment to you. Signage at the entrance and on the courts tells you when an area is being streamed.

Opting out. If you do not want to be featured, tell our staff before you start playing or email hello@fluidarena.com. We will take reasonable steps not to feature you in promotional content and to remove you from recordings we control. A live stream cannot be edited while it is running, and we cannot control content once it has been copied or shared by others on third-party platforms.

Ownership. All streams, recordings and photographs produced by or for Fluid Arena, and the rights in them, belong to FluidSports Management. You may share our published content on your own social media in the form we published it, with credit to Fluid Arena, but you may not sell it, edit it in a misleading way, or use it to suggest that Fluid Arena endorses you or your products.

Your own photography. You may take photos and videos of your own play for personal use. Please respect other players, do not film anyone who objects, and do not film in changing rooms or washrooms. Commercial filming or photography at the arena needs our written permission in advance.

Our Privacy Policy explains how footage, streams and recordings are stored, shared and retained.

11Prohibited items and activities

The following are not allowed at the arena: alcohol and illegal substances; smoking and vaping; weapons or dangerous items; glass containers on or near the courts; pets, other than assistance animals; unauthorised coaching, training or selling of goods or services; unauthorised commercial filming; and any betting or wagering on play. We may confiscate prohibited items and ask anyone breaching this section to leave.

12Players under 18

Players under 18 may use the arena with the consent of a parent or guardian, who must make the booking or purchase the membership on their behalf, accept these terms for them, and ensure they are supervised as appropriate for their age and the activity. Parents and guardians are responsible for the conduct of the minors in their care and for any damage they cause. Some sessions and events may have minimum age requirements, which will be stated when you book.

13Café, pro shop and other services

Food, drink and goods sold at the café and pro shop are subject to the prices, terms and return policies displayed at the point of sale. Coaching, yoga, run clubs, social nights and other programmes may be run by Fluid Arena or by independent partners. Where a programme is run by a partner, the partner is responsible for its delivery and may have its own terms, which we will tell you about when you sign up.

14Intellectual property and brand

The Fluid Arena name, logo, the "Elite Courts. Easy Vibes." tagline, the website, and all content, designs, photographs, video and recordings we produce are owned by or licensed to FluidSports Management and are protected by copyright, trade mark and other laws. You may not use the Fluid Arena name or logo, or copy, modify or republish our content, for any commercial purpose without our written permission.

15Use of the website

The website is provided for information about Fluid Arena and to help you contact us and book. We try to keep it accurate and available, but we do not promise that it will be error-free or uninterrupted, and information such as opening dates, prices, schedules and facilities may change. You may not use the website in any way that is unlawful, that damages or interferes with it, or that attempts to gain unauthorised access to it or to any connected system. Links to third-party sites and services are provided for convenience; we are not responsible for their content or their handling of your data.

16Communications

By contacting us on WhatsApp through the "Join the drops" link you opt in to receive event drops, open-play slots and arena news from us. You can opt out at any time by replying STOP or leaving the channel. We will still send you service messages about your bookings, memberships and plans. Our Privacy Policy explains how we use your contact details.

17Changes to these terms

We may update these terms from time to time, for example when we launch a booking platform, introduce new programmes or change our facilities. The date at the top of the page shows when they were last changed. The terms in force when you make a booking or buy a membership apply to that booking or membership. Continued use of the website or the arena after a change means you accept the updated terms.

18Governing law and disputes

These terms are governed by the laws of India. If you have a complaint, please contact us first at hello@fluidarena.com and we will try to resolve it with you. Any dispute that cannot be resolved in that way is subject to the exclusive jurisdiction of the courts at Pune, Maharashtra, without prejudice to any rights you may have under the Consumer Protection Act, 2019.

If any part of these terms is found to be invalid or unenforceable, the rest continues to apply. Our failure to enforce any part of these terms is not a waiver of our right to do so later.
